EstatesWhen someone passes away, it is often necessary to have a fiduciary (executor or administrator, usually) appointed by the Court to legally act on behalf of the estate. Even if a person has a will, the person named as executor in the will is not authorized to act on behalf of the estate until he or she is appointed by the Surrogates Court. Banks, stockbrokers, government agencies ands others may refuse to let you make withdrawals and other transactions until you are appointed. This process is called probate. David is experienced with probate matters and has handled many, especially in the Saratoga County and Warren County Surrogates Courts. He can perform this legal work efficiently and with sensitivity to your loss. Sometimes, disputes arise between heirs or others involved in estates, and David is experienced at handling these disputes and litigation. The probate proceeding should be in the county where the person who died had their principal residence at the time of their death. However, if someone dies while they are a resident of another state or country, and owns real estate in New York, an ancillary proceeding will probably be required to authorize someone to sign a deed to transfer that New York real estate. David often handles these ancillary proceedings. |
