Real Estate

The practice includes all aspects of real estate law, including purchase and sale, financing, landlord-tenant, real property disputes, environmental matters, zoning, planning boards, easements and rights of way, title matters, and every aspect of real estate practice. David represents real estate professionals, such as developers, builders, and real estate brokers, as well as individuals, first time home buyers and more experienced buyers and sellers.

Purchasing Real Estate

David's legal representation in a real estate purchase starts with a consultation. David will talk with you, in person or on the telephone, to ensure that he understands your transaction, and that you understand David's services. The next step is usually writing a purchase contract, or reviewing one prepared by a broker. After the contract is in place, David will review the title, and will be sure that all real estate taxes are paid. He will review applicable zoning and land use regulations to ensure that the current use of the property, and your proposed use, comply with applicable laws. He will draft all papers necessary for the closing, and will review all papers drafted by the other attorneys. He will work with your broker and bank to do everything possible to ensure a smooth and timely closing. As closing approaches, adjustments and costs will be finalized, so that you will know exactly what funds will be necessary, before you go to closing. All closing documents will be faxed between the attorneys, to eliminate surprises at closings, and to make closing a well planned and pleasant experience. At closing, you will receive copies of all legal documents, and will understand everything that happens.

He will work with your broker and the buyer's attorney to do everything possible to ensure a smooth and timely closing. At closing, David will ensure that you receive the funds that are due to you. You will receive copies of all legal documents, and will underatand everything that happens.

Family Transfers

There are many good reasons to consider transferring real estate within the family, including avoiding probate, protecting an estate, and managing taxes. Transfers to a younger generation can usually be done while retaining all New York State 'STAR' tax benefits which you may be entitled to because of your age.

Financing

David can recommend banks and financing options for real estate purchases, or for refinancing to take advantage of today's low interest rates. He can efficiently prepare for a loan closing, satisfying the bank that your title and real estate taxes are in order, and guiding you through the sometimes complex world of bank closings. He will coordinate all aspects of the closing with the bank attorney, to ensure that the closing is smooth, efficient, and pleasant.

Landlord-Tenant Matters

David practices all aspects of landlord-tenant law, including drafting leases and agreements, negotiations, evictions, and other court proceedings.
