WillsPeople often ask when they should write a will. Anyone with children, or with assets (especially real estate) should consider having a will. If you do not have a will, state intestacy law will specify who gets your assets upon your death. Many people are surprised to learn that a spouse does not inherit an entire estate upon his or her spouses death. The estate is often divided between a surviving spouse and children. It is important, therefore, to specify who you want to inherit your estate. David works carefully to ensure that a will can last a lifetime. You should not have to write a new will just because a usual event of life occurs, such as a birth, death, marriage, etc. We Work hard to make sure that you won't have to change your will unnecessarily. Wills are different from estate plans. Wills specify who will inherit your estate, who will be your executor, and perhaps who will care for your minor children.. Estate plans deal with minimizing estate taxes. You will have no concerns with New York or federal estate taxes unless your estate (including life insurance, real estate, retirement plans, etc., etc., etc.) exceeds $675,000.00. This amount is scheduled to increase substantially over the next several years. We do not prepare estate plans. If your estate is large enough to require an estate plan, David will recommend an estate planning attorney. |
